1. Operator Information (Service Provider)

Pursuant to Act CVIII of 2001 on Electronic Commerce Services and Act C of 2003 on Electronic Communications, the provider of the Service is:

2. Scope and Acceptance of Terms

These Terms and Conditions ("Terms") govern the legal relationship between the Operator and any person ("User") who downloads, accesses, registers for, or uses the WishBloom mobile application or associated web services (collectively, the "Service").

By creating an account or using the Service, the User acknowledges that they have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

Age Restriction: Users must be at least 16 years of age. Users under 16 may only use the Service with the verified consent of a parent or legal guardian. The Operator reserves the right to terminate accounts found to belong to users under 16 without valid parental consent.

Platform Rules: Users who access the Service via Google Play or the Apple App Store are also subject to the respective platform's Terms of Service.

3. Service Description

WishBloom is a digital wishlist and gift registry platform that allows Users to:

• Create and manage personal wishlists and gift registries
• Add gift items with titles, descriptions, prices, images, and shop links
• Share wishlists via private links or share codes
• Connect with friends and view their shared wishlists
• Reserve or contribute to gifts on friends' wishlists
• Use AI-powered gift idea generation (Gift Quiz)
• Import product data automatically from external URLs

The Service is provided over the internet and requires an active internet connection.

4. Registration and Authentication

4.1 Methods

Users may register and authenticate via:

• Email address and password (managed by Google Firebase Authentication)
• Passwordless One-Time Password (OTP) sent to the User's email address

4.2 Account Security

The Operator does not collect, store, or have access to User passwords in any readable format. Passwords are managed exclusively by Google Firebase Authentication using industry-standard security practices.

The User is solely responsible for:

• Maintaining the confidentiality of their login credentials, OTP codes, and registered devices
• All activity that occurs under their account
• Notifying the Operator immediately at stormstudio00@gmail.com if they suspect unauthorised access

4.3 Account Accuracy

Users must provide accurate and current information during registration. The use of false identities or another person's data is prohibited.

4.4 One Account Per Person

Each User may maintain one account. Creating multiple accounts to circumvent restrictions or suspensions is prohibited.

5. User Content and Conduct

5.1 User Content

The Service allows Users to submit content including list names, item descriptions, images, URLs, and profile information ("User Content"). The User retains ownership of their User Content.

By submitting User Content, the User grants the Operator a limited, non-exclusive, royalty-free licence to store, display, and process that content solely for the purpose of providing the Service. This licence terminates when the content or account is deleted.

5.2 Content Standards

Users are strictly prohibited from submitting content that:

• Is unlawful under Hungarian, EU, or other applicable law
• Infringes any intellectual property, privacy, or other rights of third parties
• Contains malware, viruses, or malicious code
• Is defamatory, discriminatory, harassing, or obscene
• Promotes illegal activities
• Constitutes unsolicited commercial communication (spam)
• Impersonates another person or entity

5.3 Prohibited Technical Conduct

Users must not:

• Attempt to reverse engineer, decompile, or extract the source code of the App
• Use automated scripts, bots, or scrapers against the Service
• Attempt to gain unauthorised access to other users' accounts or data
• Interfere with the integrity or performance of the Service
• Circumvent any rate limits or security measures

5.4 AI and Import Features

The AI gift idea generation (Gift Quiz) and product import features process data in real time. The User must not submit personal data of third parties, illegal content, or content they do not have the right to submit through these features. The Operator is not responsible for the accuracy of AI-generated suggestions or automatically imported product data.

5.5 External Links

Wishlists may contain links to third-party websites and online shops. The Operator is not responsible for the content, availability, accuracy, or privacy practices of such third-party sites. The Operator is not a party to any transaction between the User and any third-party retailer.

6. Social Features

6.1 Friend Connections

Users may send and receive friend requests using email addresses or share codes. By sending a friend request, the User consents to sharing their display name and email address with the recipient for the purpose of establishing the connection.

6.2 Wishlist Sharing

When a User shares a wishlist link or code, other persons may view the contents of that list. The User is solely responsible for deciding what content to include in a shared list and with whom to share it.

6.3 Gift Reservations

Friends may reserve items on a User's wishlist. The reservation feature is designed so that the list owner cannot see which friend has reserved which item, in order to preserve the element of surprise. The Operator cannot guarantee the fulfilment of any gift.

6.4 Gift Contributions

The group gifting (contribution) feature allows friends to pledge contributions toward a gift item. Contribution details are hidden from the gift recipient by technical design. The contribution feature is informational only; the Operator does not process or transfer any payments between users in connection with contributions.

7. Intellectual Property

7.1 Operator's Rights

All intellectual property rights in the Service, including the app design, source code, graphics, logos, and brand name "WishBloom", are owned by or licensed to the Operator. Nothing in these Terms transfers any intellectual property rights to the User.

7.2 User's Rights

The Operator grants the User a limited, personal, non-transferable, non-sublicensable, revocable licence to use the Service for its intended personal, non-commercial purposes.

7.3 Feedback

If the User provides feedback, suggestions, or ideas about the Service, the Operator may use such feedback without any obligation to the User.

8. Disclaimers and Limitation of Liability

8.1 "As Is" Provision

The Service is provided "as is" and "as available" without any warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law.

8.2 Service Availability

The Operator does not guarantee uninterrupted or error-free operation of the Service. Maintenance, updates, or technical failures may cause temporary interruptions.

8.3 AI and Automated Features

AI-generated gift ideas and automatically imported product data are provided for informational purposes only. The Operator makes no representations as to their accuracy, completeness, or suitability. Users should independently verify any product information before making purchasing decisions.

8.4 Limitation of Liability

To the maximum extent permitted by applicable law, the Operator's total liability to the User for any claim arising out of or relating to the Service shall not exceed the amount paid by the User for the Service in the 12 months preceding the claim. The Operator shall not be liable for indirect, incidental, consequential, or special damages.

This limitation does not apply to liability arising from death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability that cannot be excluded by law.

8.5 Third-Party Services

The Operator is not responsible for the acts or omissions of third-party services integrated into the App (including Google Firebase, Google Gemini, Scrape.do), except to the extent required by mandatory law.

9. Termination

9.1 Termination by the User

The User may terminate this agreement at any time by deleting their account through the App's settings ("Delete Account"). Deletion is permanent and irreversible. All User Content will be deleted in accordance with the Privacy Policy.

9.2 Termination by the Operator

The Operator reserves the right to suspend or permanently terminate any account, with or without prior notice, if the User:

• Violates any provision of these Terms
• Engages in fraudulent, abusive, or harmful conduct
• Uses the Service in a way that harms other users or the Operator

9.3 Effect of Termination

Upon termination, the User's access to the Service will cease. Provisions of these Terms that by their nature should survive (including intellectual property, limitation of liability, and governing law) shall continue to apply.

10. Coming Soon Features

The following features are currently in development and are not yet available in the Service. These Terms will be updated when they are released.

10.1 WishBloom Pro Subscription

A paid subscription tier ("Pro") is planned that will unlock additional features. When available, it will be subject to separate pricing terms, cancellation and refund policies, and payment processing conditions, which will be published as an addendum to these Terms.

10.2 Bloom Duo

A shared subscription plan for two accounts is planned as part of the Pro offering.

10.3 Pro Subscription Payments

When the Pro subscription becomes available, payments will be processed by Stripe, Inc. and/or PayPal Holdings, Inc. The Operator will not collect or store payment card data directly. Full payment terms will be published prior to launch.

11. Modifications to the Terms

The Operator reserves the right to modify these Terms at any time. Material changes will be communicated to registered Users via email or in-app notification at least 15 days before they take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms. If the User does not accept the revised Terms, they must discontinue use and delete their account.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Hungary, without regard to conflict of law principles.

For Consumers: If the User is a consumer habitually resident in an EU Member State, they also benefit from the mandatory consumer protection provisions of the law of their country of residence.

Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Hungary. Alternatively, disputes may be submitted to the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

13. Miscellaneous

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between the User and the Operator regarding the Service and supersede all prior agreements.
• Waiver: Failure by the Operator to enforce any provision of these Terms shall not constitute a waiver of that provision.
• Language: These Terms are provided in English. In case of any conflict between translations, the English version shall prevail.
